Auslegung und Inhaltskontrolle von urheberrechtlichen Wahrnehmungsverträgen spielen in der Gerichtspraxis eine erhebliche Rolle. Darum kann es zum einen in Auseinandersetzungen zwischen Berechtigten und Verwertungsgesellschaft gehen. Zum anderen spielen Auslegung und Kontrolle des Wahrnehmungsvertrags auch für die Nutzer geschützter Werke oder Leistungsschutzrechte eine Rolle, da sie Klarheit brauchen, ob sie die benötigten Rechte von der Verwertungsgesellschaft oder Berechtigten selbst erwerben müssen. Der Autor untersucht die Auslegungsregeln des Urheberrechts und des Vertragsrechts sowie die Kontrolltatbestände des Urheberrechtsgesetzes, des Urheberrechtswahrnehmungsgesetzes, des Bürgerlichen Gesetzbuchs (AGB-Kontrolle), des Gesetzes gegen Wettbewerbsbeschränkungen sowie des EG-Kartellrechts. Informiert durch eine anwaltliche Praxis einerseits und auf der Grundlage seiner wissenschaftlichen Arbeiten auf dem Gebiet des deutschen und Europäischen Vertrags-, Wirtschafts- und Urheberrechts andererseits entwirft der Autor ein System, in dem die verschiedenen Tatbestände der Auslegung und Kontrolle sich zu einem geordneten Ganzen zusammenfügen. Im Vordergrund der Arbeit steht die Dogmatik des geltenden Rechts. Darüber hinaus erörtert der Verfasser auch rechtspolitische Fragen im Hinblick auf das nationale Recht und das Gemeinschaftsrecht. Sie sind jetzt von großer Aktualität, da die Kommission der Europäischen Gemeinschaft mit ihrer Mitteilung zur "Wahrnehmung von Urheberrechten und verwandten Schutzrechten im Binnenmarkt" vom 16. April 2004 die Schaffung eines Europäischen Wahrnehmungsrechts angekündigt hat. Schriften zum Europäischen und Internationalen Privat-, Bank- und Wirtschaftsrecht - EIW Europäisierung und Internationalisierung fordern die Rechtswissenschaft in besonderem Maße heraus. Die Einteilung in Fachgebiete und das Verhältnis zu anderen Sozialwissenschaften bedürfen der kritischen Neubewertung angesichts vielfacher Wechselwirkungen. Querbezüge zwischen wirtschaftsrechtlicher Regulierung und privatautonomer Gestaltung zeigen diese Entwicklung in aller Deutlichkeit. Eine sich über Deutschland hinaus öffnende Rechtswissenschaft muß sich solchen Herausforderungen stellen. Dafür steht exemplarisch das Recht der Finanzdienstleistungen als Querschnittsmaterie von Privatrecht und (öffentlichem) Wirtschaftsrecht. Dem will die vorliegende Reihe inhaltlich und methodisch Rechnung tragen. Neben dem Bank- Kapitalmarkt- und Finanzrecht als Schwerpunkt zeigen Gesellschaftsrecht, Wettbewerbs- und Kartellrecht, Immaterialgüterrecht, Insolvenzrecht und auch Arbeitsrecht ähnliche Überlagerungen. Die intensive, international orientierte Bearbeitung der Überschneidungen von klassischem Privatrecht, insbesondere Vertragsrecht, und Wirtschaftsrecht verspricht reichen Ertrag, gerade auch auf europäischer Ebene unter dem zusammenfassenden Aspekt des Unternehmensrechts. In der Reihe soll die herausragende Monographie ebenso ihren Platz finden wie der Tagungsband, Werke auf Deutsch ebenso wie gelegentlich auf Englisch. Ökonomisch ausgerichtete Arbeiten sollen neben die juristischen treten, die den Schwerpunkt bilden. In der Reihe sollen Werke zu Europäisierung und Internationalisierung zusammen kommen, die das Wirtschaftsrecht und das wirtschaftlich gedachte Privatrecht in hervorragender Weise befördern. |

[The Interpretation and Control of the Safeguarding Agreement] The interpretation and contextual control of copyright safeguarding agreements play a substantial role in court practice. That's why for one thing disputes between authorized parties and copyright collecting companies can evolve. And for another thing, interpretation and control also play an important role for the users of protected works or ancillary copyrights, since they require clarity as to whether they must acquire the necessary rights from the copyright collecting company or the authorized parties themselves. The author investigates the interpretation rules of copyright and the law of contract as well as the control circumstances of the copyright law, the copyright safeguarding law, the civil code (AGB [general terms & conditions] control), the law against restraints of competition as well EC antitrust (cartel) law. Informed through a legal practice on the one hand, and on the other hand on the basis of his scholastic works in the realm of German and European law of contract, commercial law and copyright, the author develops a system in which the different circumstances of interpretation and control merge into an orderly whole. The dogmatic of prevailing law is in the foreground. Moreover, the author also discusses legal policy issues in view of the national law and the Community law. They are now of great relevance to the present, because the Commission of the European Community has announced the establishment of a European safeguarding right with their notification for "Safeguarding of copyrights and related protective rights in the internal market" from April 16th, 2004. |
