Mit "Differenzierte Integration in der Europäischen Wirtschafts- und Währungsunion" bezeichnet der Autor die derzeitige Situation, in der einige Mitgliedstaaten dem Euro-Währungsgebiet nicht angehören, weil sie entweder die einheitliche Währung nicht einführen können oder nicht wollen. Die Rechtsfragen, die sich hieraus ergeben, sind auch sieben Jahre nach der Einführung des Euro und mehr als zwölf Jahre nach In-Kraft-Treten des Vertrages von Maastricht, der die Vorschriften zur Wirtschafts- und Währungsunion in den EG-Vertrag einfügte, in der juristischen Literatur nur selten erörtert worden. Der Autor unternimmt es, diese Lücke zu schließen. Die Arbeit ist vor allem für all diejenigen von Bedeutung, die sich in Wissenschaft und Praxis mit dem Geld-, dem Währungs-, dem Zentralbank- oder dem Europarecht beschäftigen. Grundlegende juristische Hintergrundinformationen bietet sie aber auch den Wirtschaftswissenschaften, insbesondere für Untersuchungen zur Geld- und Währungspolitik. Als Beitrag zum Konzept der differenzierten Integration und dessen praktische Anwendung ist sie schließlich für die Politikwissenschaften von Interesse. Die Arbeit gliedert sich in vier Teile. Die erste enthält eine Einleitung, in der u.a. das Konzept der differenzierten Integration und die Hintergründe für die Verwirklichung der Wirtschafts- und Währungsunion im Wege differenzierter Integration dargestellt werden. Im zweiten und umfangreichsten Teil der Arbeit untersucht der Autor die Rechtsfragen, die sich ergeben, wenn für mindestens einen Mitgliedstaat eine so genannte Ausnahmeregelung gilt, weil dieser Staat bislang die Voraussetzungen für die Einführung des Euro nicht erfüllen konnte. Er geht hier auf alle Bereiche der Wirtschafts- und Währungspolitik ein, also neben der Wirtschafts- und Währungspolitik auch auf die institutionellen Fragen, die sich stellen, und die Voraussetzungen, unter denen ein Mitgliedstaat, für den eine Ausnahmeregelung gilt, den Euro einführen kann. Der dritte Teil befasst sich mit den Sonderregeln, die für Dänemark und Großbritannien in der Wirtschafts- und Währungsunion gelten. Die Arbeit schließt in ihrem vierten Teil schließlich insbesondere mit einem Ausblick auf den Europäischen Verfassungsvertrag und die Auswirkungen, die sich aus ihm für die Wirtschafts- und Währungsunion hinsichtlich der in der Arbeit untersuchten Fragestellung ergeben. |
